DOJ wants one national answer after lower courts blocked or narrowed similar rules through injunctions. The administration argues that military readiness, deployability, medical demands, and unit requirements justify fitness standards that would face different scrutiny in civilian employment. The petition puts the legal question directly before the justices: Does federal law permit elected leaders and military commanders to set these standards?

The larger fight is over command authority. District judges have spent years turning military personnel disputes into national policy through sweeping orders. That leaves recruits, commanders, and active-duty personnel trapped between changing administrations and competing courts. The media will frame this only as a transgender rights case.

That misses the institutional issue. Courts traditionally give military leaders broad room to make judgments involving readiness and discipline because judges do not command units or manage deployments.
